By placing an order, you agree that these Conditions apply to the agreement between you and Josephine & Co.

2. ADMISSION REQUIREMENTS FOR PURCHASE
2.1 Before making a purchase on the Website, it is essential that you provide your details - such as your name, email address, delivery address, and payment details - accurately and in accordance with the instructions. You are responsible for the accuracy of the information you provide. Josephine & Co reserves the right to reject your order if you provide incorrect information. Josephine & Co uses the information you provide solely as indicated in the privacy policy.
2.2 To place an order with Josephine & Co, you must be a consumer (not a reseller) and possess a valid credit card or bank card provided by an acceptable bank. For customers under 18 years old, parental or guardian consent is required.
2.3 Products purchased by the consumer are for personal use or as a gift and may not be resold or used for commercial purposes or any other commercial benefit. Additionally, Josephine & Co reserves the right to limit multiple quantities of an item shipped to a customer or delivery address.
3.PRODUCTS
3.1 We strive to describe the product(s) as accurately as possible on the Website. However, due to various imaging and display technologies or other technical reasons, small differences in color and other variations in the product(s) may occur. Josephine & Co cannot be held liable for these differences.
3.2 All products remain the property of Josephine & Co until all amounts owed under any agreement are fully paid, including expenses and for earlier, later, or partial deliveries. You may only sell, alienate, or encumber products once full ownership has transferred to you.
3.3 We draw your attention to the washing and care instructions on the product labels. We are not liable for damage resulting from improper product handling, including handling contrary to the instructions.
3.4 In the case of limited editions or limited production, additional restrictions, such as a limit on the number of products per customer, may apply. These additional restrictions will be communicated to you through the Website.
3.5 All products displayed on the Website are available while supplies last. This means that a product displayed on the Website may no longer be available for purchase, although we strive to reflect the available stock on the Website.
4. ORDERS
4.1 All orders are subject to our acceptance and availability, and items in your shopping cart are not reserved and may be purchased by other consumers.
4.2 Once you have completed the payment page and received your order confirmation by email, you and we cannot make any changes to your order. Therefore, please ensure that all details are correct.
4.3 If you have provided your email address to be notified when a specific product displayed on the Website becomes available, we will attempt to inform you within 48 hours from the moment the product is listed on the Website.
5. PRICE INFORMATION
5.1 Prices displayed on the Website are in euros and inclusive of VAT at the applicable rate. The euro price of a product displayed on the Website at the time the order is accepted will be maintained unless there is an obvious error.
5.2 Local charges (such as import duties, sales tax) may apply depending on your region and local customs duties. These charges are your responsibility.
5.3 Prices displayed on the Website may be changed due to currency and exchange rate fluctuations, markdowns, and other commercial factors. The price applicable to your order is the price in effect at the time your order is accepted. Prices between our products in physical stores and on the Website may vary.
5.4 We strive to accurately display all prices on the Website, but errors may occur. If we discover an error in the price of any item you have ordered, we will notify you by email of the price change and give you the option to reconfirm your order at the correct price or cancel your order. If we cannot contact you, your order will be canceled. If you have already paid for the goods, we will refund you the full amount as soon as possible. If products are recalled while in transit, we will process your refund once the products are returned to us.
6. ACCEPTANCE OF YOUR ORDER
6.1 When you place an order through our Website, we will send you an order confirmation by email. This confirming email serves to acknowledge that we have received your order but is not a confirmation of acceptance of your order.
6.2 All orders placed by you must be accepted by us. Unless you cancel your order, the acceptance of your order and the formation of the agreement between you and Josephine & Co are completed when we send you an email confirming that the goods have been dispatched.
6.3 We reserve the right not to accept your order, for example, if we cannot obtain payment authorization, if shipping restrictions apply to a particular item or delivery address, if the ordered item is out of stock or does not meet our quality control standards, or if you do not meet the admission requirements as set out in these Conditions.
6.4 We may also, at our discretion, refuse to process a transaction and thus refuse to accept it for any reason or refuse service to anyone at any time. We are not liable to you or any third party for withdrawing any products from the Website, whether or not these products have been sold, or for the removal, screening, or editing of any materials or content on the Website, or for refusing to process or canceling a transaction after processing has begun.
6.5 If we are unable to deliver in accordance with the terms outlined in the confirmation, we will contact you and give you the opportunity to cancel the order. If we have already received payment, we will refund the relevant amount to you.
7. PAYMENTS
7.1 We accept various payment methods, including Visa, MasterCard, American Express, Maestro, UnionPay, Bancontact, iDEAL, Shop Pay, Apple Pay, Google Pay, PayPal as well as any other methods clearly indicated on the Website from time to time.
7.2 If you pay with a credit card, you will be asked to provide the card number, expiration date of the credit card, and the CVC code. We use MasterCard SecureCode and SSL encryption to prevent unauthorized access to credit card information. We do not store credit card information after the transaction is completed. For more information, please refer to our Privacy Policy.
7.3 All credit card/bank card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment for any reason, we will notify you immediately at the checkout. In this case, we cannot be held responsible for any delay or non-delivery.
7.4 If we choose, or are required by applicable law, to provide or make available an invoice, we reserve the right to provide or make available electronic invoices, and you agree to this form of billing.
7.5 Promotion codes are not transferable, and there is no option to redeem promotions for cash. Additionally, promotion codes cannot be used in conjunction with other promotion codes or offers and must be redeemed on the specified date, if provided.
8. RETURNS FOR ORDERS WITH DISCOUNT CODES
If you place an order using a discount code and decide to return part of the order, the discount will be distributed proportionally across all items in your order. As a result, the refund for a returned item may be lower than its original price without the discount.
How does it work?

Discounts are applied proportionally to all items in an order.

For partial returns, you will be refunded the amount you actually paid for the returned item, including the applied discount.
Example:
Suppose you order two items priced at €50 each and use a €20 discount code. The discount is distributed evenly, so each item costs €40. If you return one item, you will receive a refund of €40.
This ensures that the discount is fairly applied to both retained and returned items. For further details, please contact our customer service team.
9. RIGHT OF WITHDRAWAL AND REFUND
9.1 You have a right of withdrawal within 30 days without giving any reason. The withdrawal period expires after 30 days from the day following the day on which you (or someone you have designated, other than a carrier) received the last delivery of the relevant order. In the case of partial deliveries, this period starts when you receive the last item of your order.
9.2 We do not exchange products. If you want to exchange a product, you must return your purchase for a refund and place a new order.
9.3 To exercise your right of withdrawal, you must notify us in writing of the withdrawal of your order by email to: info@josephineco.com.
9.4 To exercise your right of refund, you must use the return form and return label provided with the shipment. In case of a return, the following steps should be taken:
Check the box(es) of the item(s) you want to return. Also, fill in the reason for the return.
Pack your item(s) in the box/bag in which you received it/them or in another box/bag and include this return form in the shipment.
Affix the return label to the box/bag.
Take the shipment to the nearest drop-off point and keep the proof of receipt.
Once your return is received in our warehouse, we will process your refund immediately. Please note that it may take up to a week for the refund to be reflected (depending on your original payment method).
9.5 All goods must be unused and/or unworn. All original packaging with price information, labels, and tags must be intact. No tape should be applied to the item(s) or its packaging. All items must be returned in a box to protect their shape. Returns that do not comply with our policy will not be accepted and will be returned to you.
9.6 We will fully refund you, including the shipping costs you paid. If you return part of your order, we will only refund you the cost of the returned item. We may deduct an amount from the refund for the diminished value of the delivered goods if this reduction is due to unnecessary handling by you (such as, without limitation, using and/or wearing the goods).
9.7 We will refund you without undue delay, but no later than:
(i) 30 days after the day we receive back from you the goods supplied to you; or
(ii) (if earlier) 30 days after the day you provide evidence that you have returned the goods; or
(iii) if no goods were supplied: 30 days after the day we are informed of your withdrawal.
9.8 We will refund you using the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the refund.
9.9 If we have sent goods to you and you have canceled your order, we may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods, whichever comes first. If we do not receive the goods back, we may arrange for them to be collected, and the cost will be borne by you.
10. DELIVERY
10.1 We offer a range of delivery options from which you can choose the method that suits you best. Specific terms and conditions and different delivery costs may apply to various delivery options. Please refer to the complete information in our shipping policy.
10.2 We offer worldwide shipping through our partner PostNL. The exact shipping rates depend on the amount of your order and/or the country to which your order is shipped.
10.3 All shipments are insured and have a tracking number that allows the shipment to be tracked. This tracking number will be provided to you in the shipment confirmation email. It should be noted that this tracking information is hosted by the courier's website and is not controlled by us.
11. DAMAGED OR DEFECTIVE ITEMS
11.1 All items from Josephine & Co come with a one-year warranty against material defects and manufacturing defects. This warranty period may vary depending on the applicable laws of the country to which the item is shipped. This warranty covers only manufacturing defects.
11.2 If the problem is caused by reasons other than the quality of materials or the assembly process, the original product will be returned to you. We do not refund products:
obtained from a source other than the Website or a physical store of Josephine & Co;damaged by improper use or negligence (i.e., exposure to chemicals, corrosive substances, open fire, heat, sharp objects, etc.); and/or
damaged by incorrect use or activities other than the intended purpose.
11.3 The lifespan of a product depends on the individual user of the product, the conditions of use, and the specific wear patterns of the user. If our products are damaged by normal wear and tear or if their reasonable lifespan has been exceeded, they will not be replaced.
11.4 If you believe you are entitled to a warranty regarding an online purchase, you can contact our customer service by email at: info@josephineco.com. In this email, provide the original order number, photos of the alleged deficiency, and a brief description of the claim. Our customer service will determine whether the damage is due to a manufacturing defect or a deviation from factory specifications. If our customer service determines that you have a claim, the item(s) will be refunded to you or, if possible, replaced (based on availability).
12. USE OF THE WEBSITE
12.1 Sometimes, our Website may contain data with typographical errors, inaccuracies, or omissions related to product descriptions, price information, offers, quotes, shipping costs, or availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time without prior notice, modify or update data, or cancel orders in case of an obvious mistake.
12.2 You agree that you are personally responsible for your use of this Website and for all your communication and activities on and pursuant to this Website. If we determine that you are involved in or have been involved in prohibited activities, were not respectful towards other users, or otherwise violated the Terms, we may deny you access to this Website temporarily or permanently.

16. LIABILITY
16.1 Any liability and responsibility of Josephine & Co, its subsidiaries, and their respective executives, directors, employees, shareholders, or agents are excluded for any amount or any loss or damage to you or a third party (including direct or indirect loss or damage, compensatory, consequential damages, loss of income or profits, loss of goodwill, data, agreements, or loss or damage arising in any way or in connection with business interruption, missed opportunities, loss of expected savings, waste of management or office time, and whether arising from contract, tort (including negligence), or otherwise, even if foreseeable) in connection with: (i) this Website, (ii) the use, inability to use, or results of this Website, (iii) any websites linked to this Website, and (iv) all data on this Website. Your sole and exclusive remedy in connection with the above or any dispute with Josephine & Co, its subsidiaries, and their respective executives, directors, employees, shareholders, or agents is to discontinue your use of the Website.
16.2 Nothing in these Terms excludes or limits a person's liability for death or personal injury resulting from their own negligence, nor a person's liability for fraudulent misrepresentation, nor any other liability that cannot be excluded or limited under applicable law. Nothing in these Terms affects your legal rights as a consumer, such as your right to return and right to a free guarantee for defective goods.
16.3 If we fail to comply with these Terms, we are liable for loss or damage you suffer as a foreseeable result of our breach of the Terms. Loss or damage is foreseeable if it is clear that it will occur or if both you and Josephine & Co knew it could happen at the time of entering into the agreement.
16.4 We are not responsible for losses that are not caused by our failure or negligence or indirect losses that are a side effect of the main loss and that could not reasonably be foreseen by you and us (such as loss of profit or missed opportunities).
16.5 We are also not liable for the failure to fulfill any of our obligations under the Terms if such failure is due to events beyond our reasonable control.
17. MISCELLANEOUS
17.1 Article headings are for convenience only and do not affect the interpretation of these Terms.
17.2 Any failure or delay by us in the implementation of a (whole or partial) provision of these Terms cannot be interpreted as a waiver of our rights or remedies.
17.3 You are not allowed to transfer rights or obligations under these Terms without our prior written approval. We can transfer all our rights or obligations under these Terms to any of our subsidiaries or affiliated entities or to a third party designated by Josephine & Co.
18. APPLICABLE LAW AND JURISDICTION
18.1 These Terms and the agreement entered into by you and Josephine & Co are exclusively governed by Dutch law, excluding the United Nations Convention on Contracts for the International Sale of Goods.
18.2 The competent court in Amsterdam has exclusive jurisdiction to hear all disputes that may arise from these Terms or the agreement entered into by you and Josephine & Co and to settle them.
19. CHANGES TO THIS INFORMATION
19.1 Josephine & Co reserves the right, solely at its discretion, to amend these Terms at any time without notice. Changes will be published on our Website, indicating the date of the last update. If you continue to visit the Website, you are automatically bound by the amended Terms. Therefore, we recommend checking these Terms regularly. It should be noted that the Terms applicable to your order are always the terms in force at the time you place the order, not a later version.
